2. Acceptance of Terms

By accessing our website or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our website or services. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use our services.

3. Description of Services

Aether Legal provides legal advisory and document preparation services, including immigration and work permit advisory, debt recovery consultation, and partnership agreement drafting. The specific scope, deliverables, and fees for each engagement are outlined in a separate engagement letter or service agreement provided before work commences. Our services are available primarily to clients in Malaysia, though we may accept matters involving foreign elements on a case-by-case basis.

4. User Responsibilities

When using our website and services, you agree to: provide accurate and complete information when submitting enquiries or engaging our services; respond in a timely manner to requests for documentation or information related to your matter; not use our website for any unlawful purpose or in a way that could damage or impair its functionality; not reproduce, distribute, or otherwise use our website content without prior written permission; and keep any confidential information shared during the course of our engagement secure and private.

5. Intellectual Property

All content on the Aether Legal website, including text, graphics, logos, icons, and design elements, is the property of Aether Legal and is protected by Malaysian and international copyright laws. You are granted a limited, non-transferable licence to access and view the content on our website for personal, non-commercial purposes only. Documents prepared specifically for your engagement remain subject to the terms agreed upon in your service agreement.

6. Payment Terms

Fees for our services are quoted in Malaysian Ringgit (MYR) and are set out in our engagement letter or service agreement before any work begins. Payment is expected in accordance with the schedule outlined in your engagement terms. We accept bank transfers and cheques. If additional work is required beyond the agreed scope, we will discuss any fee adjustments with you before proceeding. Late payments may incur interest at the rate permitted under Malaysian law.

7. Service-Specific Terms

Immigration Advisory: Our advisory covers guidance on permit categories, documentation, and application processes. We do not control or influence decisions made by immigration authorities. Timelines provided are estimates based on standard processing periods and may vary.

Debt Recovery: Our consultation provides an assessment of your debt recovery options and may include drafting of demand letters. Successful recovery depends on many factors outside our control. We will provide an honest assessment of the viability of your claim.

Partnership Agreement Drafting: The engagement includes an initial drafting session, two rounds of revisions, and a final signing-ready document. Additional revisions beyond the included two rounds may incur additional fees, which will be discussed in advance.

8. Disclaimers

The information on our website is provided for general informational purposes only and does not constitute legal advice. While we strive to keep the content accurate and current, we do not warrant the completeness or reliability of any information on our website. Each legal matter is unique, and outcomes depend on the specific facts and circumstances involved. Past results do not predict future outcomes. You should not act on the basis of website content alone without seeking appropriate professional advice.

9. Limitation of Liability

To the maximum extent permitted by Malaysian law, Aether Legal shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or services. Our total liability in connection with any service engagement shall not exceed the total fees paid by you for the specific engagement giving rise to the claim. This limitation does not apply to liability that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify and hold harmless Aether Legal, its partners, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your use of our services, or any information you provide that is inaccurate or misleading.

11. Termination

Either party may terminate an engagement by providing written notice in accordance with the terms set out in the engagement letter. Upon termination, you remain responsible for fees incurred up to the date of termination. We will return any documents belonging to you and retain copies as required by professional obligations. Certain provisions of these Terms, including intellectual property, limitation of liability, and indemnification, shall survive termination.

12. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from or in connection with these Terms or our services shall first be addressed through informal discussion between the parties. If the dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation through the Malaysian Mediation Centre. If mediation is unsuccessful, the dispute shall be submitted to the exclusive jurisdiction of the courts of Malaysia.

13. General Provisions

These Terms and Conditions, together with any applicable engagement letter, constitute the entire agreement between you and Aether Legal regarding the subject matter herein. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any provision does not constitute a waiver of that provision. Aether Legal may not assign its obligations under these Terms without your consent, except in connection with a merger or acquisition.

14. Changes to These Terms

We reserve the right to update these Terms and Conditions from time to time. Any changes will be posted on this page with an updated effective date.
